Das Urteil in voller Länge in englischer Sprache:

Kevin Kapstad of EC-KAC is suspended for four games. The US-defenseman received a two game suspension for the present incident (Boarding) and an additional 2 game suspension for 2x repeat offender.

According to the Arbitrator and after reviewing video evidence, the player Kevin Kapstad (#51) of EC-KAC, in the game against KHL Medvescak Zagreb on Wednesday, February 21st 2018, time 42:11, made contact with an opponent deemed as Boarding IIHF Rule 119. As per the EBEL Fundamental Rules V. 5,1 (b), video evidence was sent to PSC(IDOPS) for a final verdict.

From the perspective of DOPS, Kevin Kapstad (#51) demonstrated a motion on the opposing player that is defined in the IIHF Rule Book as Boarding.

On February 21st in Klagenfurt, a situation occurred involving KAC player Kevin Kapstad, which is considered boarding. With a loose puck along the half wall in the defensive zone of Zagreb, a Zagreb player is skating to the puck. Immediately before playing the puck, the Zagreb player was pushed from behind into the boards.
The incident was raised to supplementary discipline. Kapstad had no intent to play the puck. He located himself from the attacking zone side of opposing player, through his skating lane, directly behind the opposing player. With the opposing player about to play the puck and located a dangerous distance from boards (to receive contact), Kapstad raised his stick to a cross checking position and delivered a push above the pant line, to the back of the opposing player. The opposing player was unable to protect himself and sustained an apparent injury as a result of the stick action of Kapstad. The stick action of Kapstad is not considered overly aggressive, but is considered recklessly endangering due to his 90* position to boards and opposing player and use of his stick in a illegal manner to propel force. Kevin Kapstad must take a skating approach to minimize 90* force to a player from behind and skate in a manner to work to get to the defensive side of opposing player.

With Kevin Kapstad receiving 2 past suspensions in the past 24 months, he is considered a 2X repeat offender, which elevates the suspension amount by 2 times. Kapstad receives a 2 game suspension for the present incident and an additional 2 game suspension for 2X repeat offender. Effective immediately, Kevin Kapstad (#51) is suspended for 4 games.

Key references:
– Directly from behind

The incident was determined by the EBEL PSC to be a Category 2 – ‘Reckless’ – a deliberate and/or dangerous action with no concern for the result, with a conscious action to provoke, through intent and a willful purpose. Injury is not the determining factor, but can be considered as influential means to the decision.

From the perspective of DOPS and according to the EBEL Penalty Catalog Ref Nr. 112 – Boarding, Kevin Kapstad (#51) of EC-KAC is suspended for 4 games, effective immediately.
