Das Urteil des DOPS in englischer Sprache:
According to the Arbitrator and after reviewing video evidence, player Tom Zanoski (#10) of KHL Medvescak Zagreb, during the first intermission, was involved in a Fight, IIHF Rule 141. As per the 2017/18 EBEL Disciplinary Measures, the incident was reviewed using video footage, TV footage, referee reports and player reports.
On Sunday, December 17th in Zagreb, an incident occurred in between periods and off ice. Between periods is not considered part of the 60 minutes + OT for game actions. Considering a fight ensued between 2 opposing players, the actions of both players are considered detrimental and dangerous:
– Detrimental in the sense that game officials are not present, EBEL brand and the rules and regulations of the EBEL were not adhered to
– Dangerous due to non-playing personal at risk, possibility of a multitude of people involved and for the 2 players involved in a Governed area of the facility (Off-Ice)
The facts of player location and the possibility of opposing player engagement:
– Zagreb-Tom Zanoski, due to a request for a TV interview and location of interview wall, there is cause for Tom Zanoski to be located in the vicinity of the opposing team
– BOZ – Christopher DeSousa left the ice surface to proceed to Bolzano dressing room with the lane to dressing room requiring to pass by the interview area, where Tom Zanoski was located
Penalty Decision for Zagreb’s Tom Zanoski:
The incident after review, has been determined that Tom Zanoski engaged in a off ice fight. Tom Zanoski had an obligation to proceed with the TV interview. The obligation of a TV interview is not to engage or provoke opposing players. With the interview about to begin, Tom Zanoski made a choice to leave the interview area for the purpose of verbally engaging an opposing player(s), other than Christopher DeSousa . Tom Zanoski helped escalulate the situation, willingly engaged and fought with Christopher De Sousa.
Effective immediately, Tom Zanoski is suspended for 5 games, fined the maximum amount of 2,500 Euros and has a game misconduct on his record, regarding EBEL fighting procedure, for the remainder of the 2017/2018 regular season.
Key references:
– Off ice fight
– Did not refrain from or avoid the confrontation
– Had an obligation for the TV interview and chose to enter an altercation instead
From the perspective of DOPS and according to the EBEL Penalty Catalog Ref. Nr. 105 – Altercation off the ice, Tom Zanoski (#10) of KHL Medvescak Zagreb is suspended for 5 games, effective immediately.
The incident after review, has been determined that Christopher DeSousa did not proceed directly to his dressing room and chose to stop and engage ZAG – Tom Zanoski. It is apparent, in addition to verbal means, Christopher DeSousa helped provoke a fight. There is no sufficient reason why Christopher DeSousa should have stopped and engaged the opposing player. For this reason alone, he is considered part of the problem – not the solution. It is also deemed that Christopher DeSousa holds a responsibility in why the fight happened. If he would have followed the procedures of going directly to his dressing room, not stopped and confronted, refrained from verbal usage and did not provoke, the situation may not have escalated.
Effective immediately, Christopher DeSousa is suspended for 5 games, fined the maximum amount of 2,500 Euros and has a game misconduct on his record, regarding EBEL fighting procedure, for the remainder of the 2017/2018 regular season.
Key references:
